You must be at least 13 years old to use the Service. If you are between 13 and 17, you may use it only with the consent and supervision of a parent or legal guardian, who agrees to these Terms on your behalf. You are responsible for the accuracy of the information you provide, for keeping your login credentials secure, and for all activity that occurs under your account. Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable and revocable licence to use the Service for your own, non-commercial fitness tracking. We may add, change or remove features at any time.
You agree not to:
You retain ownership of the content you create or upload — your workouts, measurements, photos, notes and profile information (“Your Content”). You grant us a limited, worldwide, royalty-free licence to host, store, process, reproduce and display Your Content solely to operate and provide the Service to you (for example, to sync it across your devices or show it to users you share it with). You are responsible for Your Content and confirm you have the rights to it. We may remove content that violates these Terms.
The Service lets you follow other users, receive follow requests, and share your profile and progress. Treat other users with respect. We may remove content, restrict features, or suspend accounts that engage in harassment, spam or abusive behaviour. Content and profiles you choose to make public may be seen by other users and, via shared links, by others outside the app.
The AI workout generator uses a third-party AI model (Google Gemini) to produce plans from the prompts you provide. AI output may be inaccurate, incomplete or unsuitable for your circumstances, and is provided as suggestions only, without warranty. You are responsible for reviewing any plan and deciding whether it is appropriate and safe for you, subject to the health disclaimer above. Do not include sensitive personal information in AI prompts.
TrainFury currently offers core features for free. We may offer optional paid features, subscriptions or one-time purchases. When we do, the following applies:
Except where required by law, payments are non-refundable. Because purchases are processed by the app stores, refund requests are handled under the Apple or Google refund policies, and you should request refunds directly through the store you purchased from.
The Service, including its software, design, logos, “TrainFury” name, exercise library and other content (excluding Your Content), is owned by us or our licensors and is protected by intellectual property laws. Except for the licence granted in Section 2, no rights are transferred to you.
The Service relies on third-party providers (including Google Firebase, Google Sign-In, Google Gemini, and the app stores). Your use of those features may also be subject to the providers’ own terms. We are not responsible for third-party services we do not control.
You may stop using the Service and delete your account at any time (see the Privacy Policy). We may suspend or terminate your access if you breach these Terms, misuse the Service, or where required by law or to protect the Service and its users. On termination, the licences granted to you end; provisions that by their nature should survive (including Sections 3, 9, 12, 13, 14 and 15) will survive.
The Service is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that data will always be preserved. You are responsible for keeping your own copies of important data where practical.
To the maximum extent permitted by law, TrainFury and its operator will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits, or goodwill, arising from or related to your use of (or inability to use) the Service, including any injury connected with exercise. To the extent liability cannot be excluded, our total aggregate liability is limited to the greater of (a) the amount you paid us for the Service in the 12 months before the claim, or (b) INR 5,000. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
You agree to indemnify and hold harmless TrainFury and its operator from any claims, damages, liabilities and expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Service, or your violation of any law or the rights of a third party.
These Terms are governed by the laws of India, without regard to conflict-of-law rules. Subject to applicable law, the courts located in [your city], India will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service. Nothing in these Terms affects mandatory consumer protection rights available to you in your country of residence.
We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, notify you in the app or by email. Your continued use of the Service after the changes take effect constitutes acceptance of the revised Terms.
